In this video, employment lawyer Doug Silverstein answers: What is gender discrimination? When men or women are treated differently for performing the same job, such as disparity in hiring, firing, promotions, and pay, this may be gender discrimination. People should also understand that in California, our laws protect not only our employment rights regarding gender and sex but gender identity and sexual orientation, as well.
Another area of discrimination is gender discrimination. This is discrimination against someone based on what their gender is, whether are they male, are they female. It is absolutely illegal to make employment decisions about someone based on their gender. Gender discrimination is typically seen as protecting women, because traditionally women have been the ones discriminated in the workplace. It used to be, back in the day, you would see ads that said something like looking for pretty young females to work as a receptionist. That is absolutely illegal and is no longer allowed. The bottom line is that California law protects gender identity just as it would any other protected category. For more information or to speak with an attorney, call (310) 997-4431
