Protecting Your Paychecks Exerienced Los Angeles Commission Attorneys

Depending on the specifics of your job and employment agreement, your paycheck may only constitute a single part of your overall income. Many workers rely on commission payments to be able to support themselves and their families. Unfortunately, it’s all too common for employers to behave in ways that are less-than-ethical, manipulating either employees or their commission agreements in a way that sees them paying less and earning more. If this sounds anything like your experience, you deserve the resources needed to truly level the playing field and hold your employers accountable. Kesluk, Silverstein, Jacob, & Morrison is here for you.

Should I File an Unpaid Commission Claim?

If you earned a commission that your employer agreed to pay you, but then your employer didn’t pay you that commission or failed to pay you the whole amount, then you have the grounds to file a claim.

Protected Commissions

CA labor law dictates that any commission agreement must be put in writing, and in order to be legally protected, your commission must be reliant on sales with which you’re directly involved. This means that any commission you earn that’s based, for example, on a percentage of what your employer brings in overall, would not qualify as a protected commission.

Your Commission Agreement

You must also make sure that your commission agreement meets specific requirements. The contract must clearly state how the commission is to be calculated and paid, and the employee must have a signed copy of this agreement. Commission earnings have to be directly tied to the employee’s performance in a way that is clearly outlined.
